Correction Mr. Ngii Ndune UNWILLING is the word or MPs are UNWILLING because they are the culprits.

I fear (Lord forbid) we shall have continous cycles of violence each suceeding one being worse until Kenyans get the courage for a BLOODY REVOLUTION throw all those burgers into jail or better bury the alive and replace them with principled leadership.

Look at it Kibaki has no balls to do anything, for him it is fait accompli he is president.

Did you not see barefooted Kenyans cheering Raila and even naming their children after that monster of a American car that he did not need in the first place?

Are these the same Kenyans who walk miles on foot to work from Kangemi,Kibera etc because they cannot afford fare?

Justice is not possible the very acts are below the radar of justice.

Nothing but a complete revolution will save Kenya, the way we are behaving, is the way we are going to suffer my dear friend. Untill we get gut to say NO!

Let's get some things correct. There are two things here:
1. Supporters cause a riot out of frustration, because their leader believes injustice has been done at the ballot. This is where Raila comes in.

2. A leader (leaders) sit, organize and FUND mayhem, killing, rape and so on. This is where those named in Waki report come in.

All I'm saying it this: Those named in Waki report either face our tribunal, OR ICC. It's that simple.
They are running scared because they think Waki report convicts them. No. Waki et al are the kenyan version of a Grand Jury - they have found reasonable reason for a few select individuals to face trial.

Stormy meeting

On Thursday, 75 ODM MPs — among them Mr Odinga and 11 Cabinet ministers — emerged from a four-hour stormy meeting and declared that the report contained “incurable errors”. They also said that it contradicted the Constitution.

Trouble began when Kipkelion MP Julius Kones said that all ODM leaders and MPs should be included in the list of suspects since they called for mass action, which led to the post-election chaos.

The post-election chaos, sparked by the announcement of disputed presidential election results on December 30, last year, left over 1,200 people dead and 300,000 displaced.

Mrs Ngilu said that Mr Odinga and President Kibaki should top the list of suspects because the rest were acting on their behalf.
Twenty MPs from central Kenya called for the formation of a new tribunal to investigate the post-election violence, giving those mentioned a chance to defend themselves.

ODM’s decision came on a day that Vice President Kalonzo Musyoka also called for the shelving of the report.

The Waki Commission gave the Government 60 days to form a special tribunal to try the suspects in the secret list or else their names will be forwarded to the International Court of Justice (ICC).

But ODM said they would shield any of their members whose name is in the secret list saying Kenya’s institutions had not collapsed to warrant such a trial and neither had the Government failed to investigate the suspects.

“ODM being part of the Grand Coalition Government will resist and stop any “rendition” or surrender of Kenya’s citizens to a tribunal outside its territory as the national jurisdiction and/or national systems have not collapsed and it is not evident that Kenya is unwilling or unable to carry out investigations or prosecutions in our courts.”

Call me a pessimist but the waki report is going nowhere neither tribunal nor ICC and if it does goverment collapses renwed fighting which my just bring us to the much needed PEOPLES REVOLUTION!

A tribunal's voice for the voiceless is an idea whose time has come. Flashback, Jan 2008 - A kina Nyachae were shown the door. How dare these guys forget so soon?

If Kibaki and Raila fail to form a tribunal, I support ICC stepping in. We have already suffered and I can assure you, the victims of post election violence are willing to pay the ultimate price - just to get a shot at JUSTICE.

THE Orange Democratic Movement on Monday backtracked on its anti-Waki stance and agreed instead to look afresh at the judge’s report.

The party’s decision possibly to reverse the decision by its own MPs is likely to put party leaders at loggerheads once again.

ODM leader Raila Odinga who only recently faced a rebellion by MPs allied to Eldoret North’s William Ruto over his support for implementing the report into post- election violence attended a National Executive Council meeting in which his MPs’ recommendations to block the report were deferred.


The executive council is the group that runs the party.

ODM MPs recently rejected the report, saying they would resist attempts to charge any of the suspects named in a secret list handed by Mr Justice Waki to former UN secretary-general Kofi Annan.

Several Cabinet ministers also criticised Mr Odinga for insisting the report must be implemented in full.

But on Monday, ODM secretary-general Anyang’ Nyong’o said the executive committee was more authoritative than the MPs’ Parliamentary Group, saying: “NEC speaks on behalf of the party. The PG concerns and ideas have been discussed by NEC and party position recommended. Members are, however, free to discuss; we have not gagged anybody.”

Prof Nyong’o named a new eight-member committee that will liaise with the party’s Strategic and Legal Affairs committee and arrive at new stand on the report within 10 days.

The committee members are Prof Tony Wambua, Ms Mumbi Ng’aru, Mr Sam Wa Njuguna, Mr Ali Dida, Mr Joseph Kiangoi, Mr Ochillo Ayacko, Mr Martin Shikuku and Mr Julius Kemboi.

Asked by journalists why it had taken so long for the party to give its position, Prof Nyong’o said ODM had taken the decision to form a committee to study the Waki report.

Only 35 days remain of the 60-day deadline for ODM and PNU to sign an agreement for setting up a tribunal to investigate those suspected of carrying out or aiding and abetting the violence.

This is a positive effect of Obama. these guys should be scrutinized, every blow against impunity is a blow for justice and a blow for a better Kenya!

AGAIN REST EASY,THE GENIUS OF THE WAKI REPORT IS, ITS A SELF TRIGGERING DOCUMENT.THE ICC IS WAITING AND AM FOR IT RATHER THAN A TRIBUNAL!ALTHOUGH I WOULD LIKE THEM TO SERVE JAIL TERM IN OUR FAMOUS JAIL HOUSES.

Act on report Waki, foreign missions say
“Alongside Kenyans, we look to Kenya’s leaders to implement the commission’s recommendations and ensure that those responsible for the violence are held to account. The group said that the commission of inquiry on the post-election violence made important recommendations towards ending the culture of impunity in Kenya. The report underlines the importance of further investigations into the post-poll violence, including sexually-related violence, and the conduct of security agencies during the crisis, the group said. “It also brings focus on the imperative of police reform and visible processes of reconciliation among the people of Kenya. The commitment to address these issues and their implications for institutional reform is anchored in the National Accord agreed by the main parties,” they said.

The tribal chiefs should not start panicking and creating tribal cocoons with the aim of seeking sympathy.
It's either Tribunal or the Hague.
No more Impunity in Kenya.
No Amnesty.

The aggresors and perpetrators of tribal violence are better tried in The Hague, though The Hague has its own credibility problems (exempting American soldiers). Our local courts and jails may not be able to handle the political pressure and public interest that the cases will generate.

Those who organised for defence (attack is the best defence) should not be dragged to Hague.
