Good people,

After tasting political blood these last couple of weeks, i feel even more thirsty for some more. It is with this in mind that we must all call for the resignation of yet another clown in the name of Otieno Kajwang. Lets all rise and chase this thug out of town. Please see the link below.

Minister overrules experts’ word on work permits

Immigration minister Otieno Kajwang’ has ignored technical advise and opened the doors to members of a controversial sect, The Standard can reveal.

In decisions that could put another member of the Grand Coalition Cabinet on the spot, the minister’s actions appear to reflect indiscriminate use of discretion.

Against the advise of his Permanent Secretary, Mr Emmanuel Kisombe and the Director of Immigration Services (DIS), Mr Joseph Ndathi, the minister gave passage to eight members of the controversial Church of Jesus Christ of Latter Day Saints.

On the minister’s orders Andrew Barney, Jordan Casey, Canton Hutchison, Basil Khuzwayo, Michael Papworth, Solly Sibiya, Jordan Skidmore and Clayton Whiting — all members of the Latter Day Saints — were eventually allowed entry.

Mr Ndathi, the DIS, remarked exasperatedly after the minister ignored his counsel and directed that the papers be processed: "The minister has ruled despite my technical advise that these permits should not be approved."

"These permits have delayed inordinately even after I directed that they be issued. Can they be released today!" Kajwang’, had earlier ordered the DIS.

Documents in our possession show 17 members of the sect had initially applied to enter the country. The DIS had cleared 10 members of the sect but barred the seven.

His terse comment when reached on the telephone yesterday was: "I am the minister in charge and the buck stops with me. Nobody can purport to teach me what to do."

Foreigners given work permits

The minister has also approved work permits and ordered the issuance of citizenships ignoring the professional opinion of technical staff.

Mr Kajwang’ has also approved 15 work permits and 15 citizenships for foreigners, mostly Asians.

Ordinarily, the minister is expected to rely on the advise and guidance of the PS and DIS in carrying out this important exercise.

In one case of an immigrant seeking a work permit, the minister told off the PS and DIS and ruled: "I have read the advice. I, however, direct that the permit be given for two years."

The professional opinion of both the PS and DIS was that the particular job for, which was being sought by the foreigner, could be done by locals.

"He is a BSc and BCom degree holder. He is employed by a retail store. These are jobs that should be preserved for Kenyans," Ndathi wrote. On his part the PS concurred: "Agreed, this job can be done by Kenyans."

But five days later, the minister shoved aside the recommendations and ordered that the foreigner be issued with a two-year permit.

The Economic Survey puts unemployment rate in the country at 65 per cent, one of the highest in the world. The National Rainbow Coalition’s pledge to create 500,000 jobs between 2003 and 2007 was largely unmet. Thousands of qualified Kenyan youths remain jobless.

Veto powers

Drawing from the veto powers vested on him by the Immigration Act, Mr Kajwang’ as late as last week refused to take the advice of technical staff.

According to the Immigration Act, Chapter 172 Section 10, all Immigration officers draw their power from the minister.

It states, among other things that "there shall be such number of Immigration officers as may be necessary for the purpose of this Act. In the performance of their functions under this Act, Immigration officers shall act in accordance with such instructions as may be given by the minister".

Overlooking the comments of Mr Ndathi, who refused to grant a foreign businessman a Class H work permit, the minister went ahead and sanctioned the application.

In a letter dated June 3, Ndathi states: "The applicant submitted an application for class H entry permit on August 16, 2006. The applicant did not meet the minimum capital requirement provided by the law, consequently the rejection should be upheld."

According to the letter to Kajwang’, the applicant had low capital (Sh1,090,667). The minimum capital for any investor provided by the investment promotion Act, 2004 is US$100,000(approximately Sh6.2 million).

"I have seen your advise, but I have directed that the work permit be granted," the minister lashed back, utterly disregarding the advise set in law under the Investment Promotion Act, 2004.

In another case, involving an Ethiopian woman seeking Kenyan citizenship, the minister directs the DIS to process her papers by merely stating he is satisfied the lady is entitled to a Kenyan citizenship.

"I have read the application of Elizabeth Tadile Abe and the attached documents. I am satisfied that she is entitled to Kenyan citizenship. Urgently process the necessary documentation for my signature," Kajwang’ directed

It is well known that Kajwang embezzled clients money when he was in law practice, it is a fact that he is not entitled to run a country's affairs as his character is highly questionable.

Kajwang is not beyond taking bribes to issue work permits and citizenship. That he is overuling experts is another evidence of his undue interest on that matter.
As he can overule his technical staff he cannot overule us Kenyans, he has to be accountable, we need explanation, fast.

Kajwang explanation is extremely lame considering the fact that even ministers are supposed to be accountable for their action.

somebody should remind him of the terms, accountability or transparency", and why they are very big words when it come to eradicating corrupt practise.

he should also resign because of his un-refutable corrupt past.

remember president Kibaki promised kenyan's a cabinet of clean leaders only.

Kajwang, SHOULD RESSIGN IMMEDIATELY if he has intergrity.

odinga, wako and the rest we are still waiting for your resignation to pave way for investigation. like MR. Kimunya you should lead by example and practice what you preach. don't tell us what is wrong let hear that from the investigators report.

Who sold the GRH? Kimunya and his mafia in CBK, NSIS and Treasury.

Whom did they tell before they sold it? Only themselves, their associates and the President.

Who is responsible for the fraduluent sale? The mafia and its associates who delivered the deal.

Are the WITNESSES to a CRIME guilty? HELL NO!!!

Personally, I never thought Kajwang belonged to the `clean' Grand Coalition. He has been mentioned adversely in eating clients money.

The Grand coalition together with ODM should seize this opportunity and get him out of there. Let's speak with one voice.

That will put the other `suspect' ones on notice. You can only hide your farts for so long. They eventually start stinking the entire room!!!

Kajwang should never have been in the cabinet in the fist place. His integrity is quetionable, a fact proved by none less than LSK. He does not deserve the title honourable it is demeaning to the august house to have thieves sitting there.
I guess these facts were ignored because of the crisis then.

Immigration minister Otieno Kajwang’ approved work permits for a foreign welder and a salesman against the advice of senior immigration officials, according to documents seen by the Nation.

The Director of Immigration Services had opposed the issuance of the work permits arguing that there were enough Kenyans with the skills and there was no need to allow the foreigners to work in Kenya.

In both cases, Mr Kajwang’ responded: “I have noted the comments of DIS. I have interviewed the applicant. I hereby grant a further two years work permit.”

Later Day Saints

Mr Kajwang’ had earlier given similar permits to eight members of the Church of Jesus Christ of Later Day Saints.

The Nation first broke the story about investigations into the Ministry of Immigration on Monday.

But responding Thursday, Mr Kajwang’ denied any wrongdoing and said he had always acted within the law. He also denied allegations that he was involved in corrupt deals. According to him, the law gave the Immigration minister “he ultimate powers” to issue work permits and citizenship documents.

Mr Kajwang’ had been accused of ignoring technical advice from his juniors before issuing permits arbitrarily to foreigners with questionable character and backgrounds.

He was also accused of issuing work permits to members of a controversial church and foreigners with questionable education backgrounds.

But on Thursday, he challenged those making the allegations to produce tangible evidence “and I will surely resign”.

“I wonder who my accusers are since nobody has come forward with any documents showing that I acted in a corrupt manner,” Mr Kajwang told a press conference held at his Nyayo House office.

Overlooked advice

The minister said he overlooked the advice of his Permanent Secretary, Mr Emmanuel Kisombe and the Director of Immigration of Services (DIS), Mr Joseph Nduati, in granting work permits to eight members of the Church of Jesus Christ of Latter Day Saints “because I saw no reason to deny them entry”.

“The application was from church missionaries who wanted to come to Kenya to preach and support some development activities in the country. I have a soft spot for people who preach,” Mr Kajwang’ said.

More damning evidence has emerged on Cabinet minister Otieno Kajwang’s excesses at the ministry.

Investigations by the Nation have revealed that Mr Kajwang went out of his way to ensure that a welder from a foreign country was granted a two-year work permit despite being advised against it by Mr Ndathi last month.

According to documents, Mr Ndathi had advised the minister against the move.

“These are skills that are plenty in the local Kenyan labour market. The application was rejected by the Entry Work Permit Steering Committee on this basis. Appeal is not recommended,” Mr Ndathi had said in a letter to the minister.

But Mr Kajwang’, even in the absence of Mr Kisombe went ahead and granted two years work permit to the welder.

There are 750 polytechnics across the country which churn out thousands of students to the job market every year. Many of these polytechnics offer welding courses.

On June 20, the day he granted the welder the work permit, he also dished out another to a middle level manager working at a factory in Nairobi’s Industrial Area.

Entry permit

Mr Ndathi had earlier indicated that the appellant had only been granted a one year dual entry permit to allow him to hand over to a Kenyan. The permit expired last month.

“It is my recommendation that this position be upheld in order to create employment for Kenyan citizens,” Mr Ndathi told the minister on April 29.

But last month, Mr Kajwang’ wrote: “I have noted the comments of the DIS. But after interviewing the applicant, I hereby grant a permit for two more years.”

Sources at the ministry disclosed that the minister had approved scores of work permits which had earlier on been rejected by the immigration officers.

KAJWANGS PROBABALE DOUBTS OR PERCEPTIONS OF INTERGITY ARE IMPACTED BY HIS PAST DEEDS AS A LAWYER AND WHERE HE WAS AT ONE TIME SUSPENDED BY THE LSK.

NOW IF WE CHECK HOW MANY OF OUR POLITICIANS (INCLUDING THE KIFAKI MAN HIMSELF) HAVE INTEGRITY, WE WOULD BE SHOCKED TO SEE ZERO!

depends on "which makosa". did he break the law? does he have powers to over rule his JUNIORS?

but if he is caught in anything that suggests he received monies for services as a minister, hakuna kulilia yeye. atabeba mzigo wake pekee yake.

OVER ruling your juniors is not a guilty verdict.

What i find strange is the people here (some of whom) are performing low-wage skilled jobs abroad at the mercy (and allowance) of those countries immigration authorities, HYPOCRITICALLY shouting for foreigners to be deported or denied entry to Kenya.

Some of you here are chasing "papers" of other countries and "kuoa ama kulipisha kitu kidogo" for it all in the name of being ka-legal.

But hypocritically here you are wanting Kenya to not give similar privileges to other foreigners in Kenya.

Si mrudi kwenu basi. Mnafanya nini ngambo??
